1. See your records or get a copy
You can look at your dental records or get a copy, including your X-rays.
- How to ask: put your request in writing. Use our form, write a letter, or email privacy@smilexprodentistry.com (our only official email). Regular email isn’t encrypted, so please don’t attach photos of your ID or insurance card; we’ll confirm who you are by phone. Our front desk can help you.
- How fast:
- An electronic copy of records we keep on the computer: within 15 business days after we get your written request.
- Our goal is 15 business days for every request. The law’s outer limit is 30 days.
- What it costs:
- Looking at your records in our office: free.
- Standard electronic copy (for example on a secure link, or by email if you ask for it): free.
- Electronic copy on a USB drive: only the cost of the drive and postage, no more than $6.50.
- Paper copies: only our actual cost for copying labor, supplies and postage, never more than the Texas dental board’s limit ($25 for the first 20 pages, then $0.15 a page). X-ray copies also have set limits. We don’t charge a search or retrieval fee for your own copy.
- We’ll tell you the price before we make the copy.
- Money never holds up your records.
- We will never hold back your records because you owe us for dental work.
- If you haven’t paid a copy fee yet, we’ll still send your copy on time and bill you later.
- Sending records to someone else:
- To another dentist: you can have copies sent straight to another Texas dentist who will treat you. We’ll send them within 30 days.
- Electronic copy to another person: sign a written request that says who gets it and where to send it.
- Paper copies to another person: we need your signed permission form (an “authorization”).
- If we say no: this is rare. If we can’t share part of your records, we’ll tell you why in writing. Sometimes you can ask another dentist to review that decision.
2. Fix a mistake in your records
If you think something in your records is wrong or missing, you can ask us to fix it. Ask in writing and tell us why. We’ll answer within 60 days. If we say no, we’ll explain why, and you can add your own statement to your records.
3. Get a list of who we shared your records with
You can ask for a list of times we shared your health information over the past 6 years, who got it, and why. The list leaves out some things, like sharing for your care, for billing, or sharing you asked for. Your first list each year is free.
4. Ask us to limit what we share
You can ask us not to use or share some of your information.
- We don’t always have to agree, but we’ll listen and tell you our answer.
- Paying yourself: if you pay for a visit or item in full, out of pocket, you can ask us not to tell your insurance company about it. We will say yes, unless a law says we must share it.
5. Choose how we contact you
You can ask us to reach you a certain way, like only on your cell phone, at a different address, or by email instead of mail. We will say yes to reasonable requests, and you don’t have to tell us why.
6. Get a paper copy of our privacy notice
You can ask for a paper copy of our Notice of Privacy Practices at any time, at either office, even if you already have it online.
7. If there is a breach
If your information is ever involved in a breach, we will tell you.
8. Choose someone to act for you
If you have a legal guardian, or you’ve given someone medical power of attorney, that person can use these rights for you. In most cases a parent or legal guardian can act for a child under 18. Texas law has some exceptions, for example when a minor can legally consent to their own care. We’ll check the person’s papers before we share anything.
9. Make a complaint
If you think we didn’t protect your privacy or follow these rights, you can complain. We will never treat you differently or punish you for making a complaint.
- Tell us first, if you’d like: Privacy Officer, Dr. Tri Trinh, DMD, (281) 469-4500, privacy@smilexprodentistry.com. Or ask at either office. (Please don’t email photos of your ID or insurance card.)
